  1. Should you no longer agree to the storage of your personal data or should it have become inaccurate, we will, upon your instruction and within the framework of the legal provisions, arrange for the deletion, correction or blocking of your data.

(5) Security of your data

  1. Your personal data provided to us is secured by taking all technical and organizational security measures to ensure it is inaccessible to unauthorized third parties. When sending highly sensitive data or information, we recommend using postal mail, as complete data security cannot be guaranteed via email.
  2. A customer account is only possible after entering your personal password. You should always keep your login information confidential and close the browser window when you have finished communicating with us, especially if you share the computer or mobile device with others.
  3. For the purpose of credit assessment, we reserve the right to use your personal data for the purpose of creditworthiness assessment and to compare it with your address and creditworthiness data stored at various companies.
  4. Your data will only be shared internally for sending informational materials and for our own advertising purposes. It will not be shared with any other third parties.
  5. If you agree to the use of your personal data for the purpose of sending you our free newsletter and information about promotions and new products, you give your consent during registration. Please note that you can revoke your consent at any time with effect for the future.
  6. We save the contract text and send you the order details by email. You can view the terms and conditions at any time. You can view your past orders in our customer login area.

(6) Social Plugins

  1. Our website uses social plugins from Facebook, Twitter, and Google. Therefore, our website displays a "+1", "Tweet", or "Like" button. These are services offered by the US companies Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA) and Facebook Inc. (1601 S California Ave, Palo Alto, CA 94394 USA), as well as Twitter, Inc. (1355 Market St, Suite 900, San Francisco, CA 94103).
  2. Only when you click the "+1", "f", or "Tweet" button does your browser establish a direct connection to the servers of Facebook, Twitter, or Google. The content of the "+1", "Tweet", "f", or "thumbs up" button is then transmitted directly from Google or Facebook to your browser and integrated into the website. Therefore, we have no control over the amount of data that Google or Facebook collects via this button.

  • 14. Storage duration

(1) Personal data that has been communicated to us via our website will only be stored until the purpose for which it was entrusted to us has been fulfilled. Where commercial and tax law retention periods must be observed, the storage period for certain data may be up to 10 years.

(1) German law shall apply exclusively.

(2) In relation to a consumer, this choice of law shall only apply to the extent that it does not restrict any mandatory legal provisions of the State in which the consumer has his domicile or habitual residence.

(3) Claims by the customer for expenses incurred for the purpose of subsequent performance, in particular transport, travel, labor and material costs, are excluded to the extent that the expenses increase because the goods delivered by us have subsequently been moved to a location other than the customer's place of business, unless the relocation corresponds to their intended use.

(4) The purchaser's recourse claims against us exist only to the extent that the purchaser has not entered into any agreements with its own customers that extend beyond the legally mandatory warranty claims. Furthermore, Section 3 applies accordingly to the scope of the purchaser's recourse claim against the supplier.

(5) There is generally no warranty. Warranty claims can only be made if warranty agreements are available in writing from Magswitch Technology Europe GmbH.

  • 16 Other

(1) This contract and all legal relations between the parties shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

(2) The place of performance and exclusive jurisdiction shall be Ingolstadt or another statutory place of jurisdiction at our option, provided that the customer is a merchant within the meaning of the German Commercial Code or a public corporation.

(3) All agreements made between the parties for the purpose of executing this contract are set out in writing in this contract.

(4) Should individual provisions of this Agreement be or become invalid or contain a gap, the remaining provisions shall remain unaffected.
